Terms & Conditions (T&Cs) of Finding Dodo OG

I. Scope

1.1 This website is operated by Finding Dodo OG. The terms “we,” “us,” and “our” refer to Finding Dodo OG.

1.2 These T&Cs govern the contractual relationship between Finding Dodo OG and you as a customer of findingdodo.com.

1.3 Any conflicting terms from the customer do not apply unless we have expressly agreed to them in writing.

1.4 We reserve the right to update or amend these T&Cs at any time. The current version is always available on our website.

II. Conclusion of Contract

2.1 The presentation of products on findingdodo.com does not constitute a binding offer, but merely an invitation to order.

2.2 By clicking the “Pay Now” button, you submit a binding offer to purchase.

2.3 After submitting your order, you will receive an order confirmation by email, which does not yet constitute acceptance.

2.4 The contract is concluded when we accept your offer within two weeks by email confirmation or by shipping the goods.

2.5 If delivery is not possible, we will inform you and, if applicable, refund any payments already made.

2.6 The contract language is German. Other language versions are for information purposes only. In the event of discrepancies, the German version is authoritative.

III. Prices and Shipping Costs

3.1 All prices on findingdodo.com are in EUR and include VAT for delivery within the EU. For deliveries outside the EU, additional customs duties and taxes may apply.

3.2 Shipping costs depend on the destination country. The total price, including purchase price, VAT, and shipping, is displayed before you finalize your order. Shipping costs are also listed in our FAQ.

3.3 Discount Codes - Each discount code may be used once per customer and per order, unless otherwise stated. Multiple codes cannot be combined. Cash redemption or alternative use is not possible. Personalized codes are non-transferable.In case of partial returns, discounts are applied proportionally to the remaining items. Refunds are based on the actual paid price, including any applied discount. If return invalidates a promotion (e.g., minimum order or bundle), we reserve the right to adjust the discount.

IV. Payment Terms

4.1 We offer various payment methods. We do not guarantee that all methods will be available to every customer. Payments processed through external providers (e.g., Sofort, PayPal) are also subject to the provider’s terms.

4.2 The purchase price is due upon conclusion of the contract unless otherwise agreed.

4.3 In case of late payment, we may charge statutory default interest: 4% for consumers and 9.2% above the base rate for businesses, plus reasonable collection costs for business customers.

4.4 Set-off by the customer is only permitted if the counterclaim is legally connected, has been judicially established, or acknowledged by us.

4.5 Rights of retention may only be exercised for claims arising from the same contract.

V. Delivery Conditions

5.1 Unless stated otherwise, delivery is made to the address you provide. We aim to deliver by the date stated in the shipping confirmation, or within the estimated period shown for the chosen shipping method. In any case, delivery occurs no later than 30 days from the order confirmation.

5.2 Delivery is made by a shipping service selected by our fulfillment partner.

5.3 Partial deliveries are permitted if reasonable for you.

5.4 Risk passes to the consumer when the goods are handed over to the consumer or a third party other than the carrier. If the consumer contracts the carrier themselves without using a proposed option, risk passes once the carrier takes possession.

VI. Consumer Right of Withdrawal

6.1 If you are a consumer under the Austrian Consumer Protection Act (KSchG), you are entitled to statutory withdrawal rights:

6.2 Withdrawal Period: 14 days from receipt of goods (or last item if multiple deliveries).

6.3 Exercising the right: Notify us via email (info@findingdodo.com) or post (Finding Dodo OG, Schönbrunner Straße 179/3/6, 1120 Vienna) of your intent to withdraw. Sending the notification before the period expires is sufficient.

6.5 We will refund all payments, including standard delivery costs, within 14 days of receiving your withdrawal notice. Refunds use the same payment method unless agreed otherwise. If we have not offered to collect the goods, we may withhold the refund until the goods are returned.

6.6 You must return goods promptly, no later than 14 days from notice. You bear return shipping costs. Goods must be packaged appropriately. Any loss in value caused by handling beyond checking the item’s nature, characteristics, and function must be compensated.

6.7 Exceptions: Personalized items made to customer specifications (e.g., blankets or scarves with initials or custom patterns) cannot be withdrawn if clearly stated before purchase.

VII. Retention of Title

Goods remain the property of Finding Dodo until full payment is made.

VIII. Warranty

Finding Dodo is liable for defects according to applicable law.

IX. Liability

9.1 Liability for intent or gross negligence follows statutory rules. For slight negligence, liability is limited to essential obligations (main duties) and typical foreseeable damage.

9.2 Liability for injury to life, body, health, or under the Product Liability Act remains unaffected.

X. Copyright

Content on findingdodo.com (images, logos, text) is protected by copyright and/or trademark law.

XI. Consumer Dispute Resolution (EU)

11.1 The EU Online Dispute Resolution platform is at: https://ec.europa.eu/consumers/odr/

11.2 Austrian Internet Ombudsman: www.ombudsmann.at

11.3 We are willing to participate in dispute resolution procedures.

XII. Miscellaneous

12.1 Austrian law applies. UN Sales Convention and related provisions are excluded.

12.2 Jurisdiction: Consumer in Austria → local court; EU consumer outside Austria → consumer’s location; business → Finding Dodo headquarters.

12.3 Place of performance: Finding Dodo OG headquarters.

12.4 Invalid provisions do not affect remaining T&Cs.

12.5 Communication may be electronic; using this site constitutes consent.
